1. Acceptance of Terms

Welcome to Texas 2A Mantique, LLC ("we," "our," "us," or "the Store"). By accessing our store location, using our website, or making a purchase from us, you ("you," "your," or "Customer") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services or make purchases from our store.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website or in-store. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility and Age Requirements

General Requirements

You must be at least 18 years of age to make purchases from Texas 2A Mantique, LLC.

Firearms Purchases

• Handguns: You must be at least 21 years of age to purchase a handgun

• Long Guns (Rifles/Shotguns): You must be at least 18 years of age to purchase a long gun

• Valid Identification: You must provide valid, government-issued photo identification

• Legal Eligibility: You must be legally eligible to purchase and possess firearms under federal, state, and local law

Ammunition Purchases

• You must be at least 18 years of age to purchase rifle or shotgun ammunition

• You must be at least 21 years of age to purchase handgun ammunition

• Valid identification is required for all ammunition purchases

Prohibited Persons

Federal and state law prohibits certain individuals from purchasing or possessing firearms and ammunition. By making a purchase, you certify that you are not prohibited from purchasing or possessing firearms or ammunition under any applicable law.

3. Firearms Transactions

Federal Requirements

All firearm purchases are subject to federal law, including but not limited to:

• Completion of ATF Form 4473 (Firearms Transaction Record)

• Successful completion of a NICS (National Instant Criminal Background Check System) background check

• Compliance with the Gun Control Act of 1968 and subsequent amendments

• Compliance with all applicable ATF regulations

Background Checks

• All firearm purchasers must undergo a federal background check through NICS

• We reserve the right to refuse any sale if the background check is delayed or denied

• Background check fees, if any, are non-refundable

• You authorize us to submit your information to NICS for the purpose of the background check

Waiting Periods

Texas does not impose a mandatory waiting period for firearm purchases. However, if your NICS background check is delayed, you will not be able to take possession of the firearm until the check is resolved.

Multiple Sales Reporting

Federal law requires us to report multiple handgun sales (two or more handguns purchased within five consecutive business days) to the ATF and local law enforcement.

Straw Purchases Prohibited

It is a federal crime to purchase a firearm on behalf of another person (a "straw purchase"). By completing the purchase, you certify that you are the actual buyer and that the firearm is being purchased for your own use.

4. Pricing and Payment

Pricing

• All prices are subject to change without notice

• Prices listed in-store or online are in U.S. dollars

• We reserve the right to correct pricing errors

• Applicable taxes will be added to all purchases

• Shipping and handling fees, if applicable, will be added to online or transfer orders

Payment Methods

We accept the following forms of payment:

• Cash

• Credit/Debit Cards (Visa, Mastercard, American Express, Discover)

• Apple Pay, Cash App and other online methods accepted.

Payment Processing

• Payment is due at the time of purchase

• For firearm purchases, full payment may be required before background check processing

• Credit card charges will appear on your statement as "Texas 2A Mantique, LLC" or similar

Declined Payments

If your payment is declined or reversed, we reserve the right to cancel your order and pursue collection of any amounts owed.

5. Returns and Refunds

Please refer to our separate Return and Refund Policy for detailed information. Key points include:

• Firearms: All sales are final. No returns or refunds on firearms

• Ammunition: All sales are final. No returns or refunds on ammunition

• Other Items: 30-day return period with original receipt; subject to management approval

• Manufacturer Warranties: Defective products are covered under manufacturer warranties

6. Product Information and Descriptions

Accuracy

We strive to provide accurate product descriptions, specifications, and imagery. However:

• Product descriptions and images are for informational purposes only

• Actual products may vary slightly from descriptions or images

• We do not warrant that product descriptions are error-free or complete

• We reserve the right to correct errors or update product information

Availability

• Product availability is subject to change without notice

• We reserve the right to limit quantities or refuse sales

• Special orders and transfers are subject to availability and supplier terms

Used and Consignment Firearms

• Used firearms are sold "AS IS" without warranty from Texas 2A Mantique, LLC

• We make reasonable efforts to accurately describe the condition of used firearms

• Manufacturer warranties may not apply to used firearms

• All used firearm sales are final

7. Layaway Policy

We offer layaway on select items subject to the following terms:

• Minimum 35% down payment required

• Layaway period: 60 days

• Items on layaway cannot be returned

• If layaway terms are not met, deposits may be forfeited or subject to restocking fees

• Firearms on layaway are subject to background check at time of final payment and pickup

8. Special Orders and Transfers

Special Orders

• Special orders require to be paid in full before ordered.

• Special orders are non-refundable

• Delivery times are estimates and not guaranteed

• You will be notified when your special order arrives

• Special orders must be picked up within 5 days of notification

FFL Transfers

• We accept firearm transfers from other Federal Firearms Licensees (FFLs)

• Transfer fee: $[amount]

• Transferring FFL must send a copy of their current FFL to us before shipping

• All transfers are subject to successful background check

• Transfer fees are non-refundable

• We reserve the right to refuse any transfer at our discretion

9. Shipping and Delivery

Firearms Shipping

• Federal law requires firearms to be shipped to a licensed FFL

• We do not ship firearms directly to non-FFL individuals

• Customer is responsible for all shipping costs and insurance

• Customer is responsible for any FFL transfer fees at receiving dealer

Risk of Loss

Risk of loss and title for items pass to you upon delivery to the shipping carrier.

10. Liability and Disclaimers

Use of Firearms

• Firearms are dangerous weapons that can cause serious injury or death if misused

• You are solely responsible for the safe handling, storage, and use of any firearm purchased

• You agree to follow all firearms safety rules and applicable laws

• We strongly recommend firearms safety training for all firearm owners

Assumption of Risk

By purchasing a firearm or ammunition, you acknowledge and assume all risks associated with ownership, possession, and use of firearms and ammunition.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Texas 2A Mantique, LLC shall not be liable for any injuries, deaths, property damage, or other losses arising from the use or misuse of any products purchased from us

• Our total liability for any claim shall not exceed the purchase price of the product

• We are not liable for indirect, incidental, consequential, or punitive damages

• We do not warrant that products are suitable for any particular purpose

Product Warranties

• Products are covered by manufacturer warranties only

• We make no warranties, express or implied, regarding products sold

• We disclaim all warranties including merchantability and fitness for a particular purpose

• Manufacturer warranty claims should be directed to the manufacturer

Indemnification

You agree to indemnify, defend, and hold harmless Texas 2A Mantique, LLC, its owners, employees, and agents from any claims, liabilities, damages, or expenses (including attorney fees) arising from:

• Your use or misuse of any product purchased from us

• Your violation of these Terms or any applicable law

• Your violation of any third-party rights

11. Prohibited Conduct

You agree NOT to:

• Provide false information on any form, including ATF Form 4473

• Attempt to purchase firearms or ammunition if you are prohibited by law

• Make straw purchases or purchase on behalf of prohibited persons

• Engage in any illegal activity on our premises or through our services

• Harass, threaten, or abuse our staff or other customers

• Damage or tamper with our property or merchandise

• Record video or audio on our premises without permission

• Carry firearms in a manner that violates our store policies or applicable law

Violation of these prohibitions may result in:

• Immediate termination of the transaction

• Removal from the premises

• Ban from future purchases

• Reporting to law enforcement

• Legal action

12. Store Policies

Firearm Handling

• All firearms must be unloaded before entering the store

• Customers may not handle merchandise without staff assistance

• Chamber and magazine checks will be conducted on all firearms brought into the store

• Unsafe firearm handling may result in removal from the premises

Photography and Recording

Photography and video/audio recording on our premises is prohibited without prior written permission.

Loitering

Customers are welcome to browse, but loitering or disruptive behavior may result in being asked to leave.

13. Privacy and Data Collection

Your privacy is important to us. Please review our separate Privacy Policy for information about how we collect, use, and protect your personal information.

By making a purchase, you acknowledge that:

• We are required by federal law to collect and maintain certain information about firearm transactions

• ATF Form 4473 and related records will be maintained for at least 20 years

• Your information may be disclosed to law enforcement and regulatory agencies as required by law

14. Intellectual Property

Trademarks and Copyrights

All content on our website and in our store, including text, graphics, logos, images, and software, is the property of Texas 2A Mantique, LLC or its content suppliers and is protected by U.S. and international copyright and trademark laws.

License

You are granted a limited, non-exclusive, non-transferable license to access and use our website and materials for personal, non-commercial purposes only.

Restrictions

You may not:

• Reproduce, distribute, or create derivative works from our content

• Use our trademarks or branding without written permission

• Frame or mirror our website content

• Use automated tools to access or scrape our website

15. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms or your use of our services shall be brought exclusively in the state or federal courts located in Lamar County, Texas. You consent to the personal jurisdiction of these courts.

Limitation of Actions

Any claim or cause of action arising out of your use of our services must be filed within one (1) year after the claim arose, or it will be permanently barred.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Texas 2A Mantique, LLC regarding your use of our services and purchases from our store.

19. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms at any time without notice.

20. Compliance with Laws

Your Obligations

You are solely responsible for complying with all federal, state, and local laws regarding the purchase, possession, transportation, and use of firearms and ammunition, including but not limited to:

• Federal Gun Control Act and regulations

• National Firearms Act (for NFA items)

• Texas state firearms laws

• Local ordinances and regulations

• Transportation laws when traveling across state or jurisdictional lines

Export Restrictions

Firearms, ammunition, and related technical data are subject to U.S. export control laws. You agree not to export or re-export any products in violation of applicable laws.

Reporting Requirements

You agree to comply with all applicable reporting and registration requirements for firearms in your possession.
